Terms and Conditions

1. Scope
These Terms and Conditions ("Terms") govern the use of the BikeGraz platform (bikegraz.at), operated by Michael Fraß, Wiener Straße 10a, 8020 Graz, Austria (hereinafter the "Operator"). By registering or using the platform, you agree to these Terms.
2. Description of Services
BikeGraz is a community platform for cyclists in and around Graz. It offers, among other things:
- Discovering and sharing bike routes and rides
- An event calendar for cycling events
- Community features such as RideAlong, mentoring and clubs
- A directory of cafés, shops and workshops in Graz
- A marketplace for bicycle equipment
- Paid premium tours with GPS navigation
- Advertising options for partner businesses (impression-based and time-based campaigns)
- A referral partner program: commission-based tour referrals for local businesses (hotels, accommodations, bike rental, tourism, gastronomy)
3. Registration & User Account
Registration is free of charge. It requires a valid email address and that you are at least 16 years old. You are responsible for the confidentiality of your access credentials and liable for all activities carried out through your account.
The Operator reserves the right to suspend or delete accounts without giving reasons, in particular in the event of a breach of these Terms.
4. User Obligations & Prohibited Content
You agree to use the platform only for lawful purposes. In particular, it is prohibited to:
- publish content that is unlawful, offensive, discriminatory or misleading
- upload copyrighted material without authorization
- use the platform for spam, automated mass queries or scraping
- circumvent security mechanisms or harm other users
- use false identities or manipulated location or tour data
5. User Content & Copyright
For content you publish on the platform (e.g. photos, tours, comments), you grant the Operator a non-exclusive, worldwide, royalty-free right to use, reproduce and display it as part of operating the platform. Copyright remains with you. You warrant that you are authorized to publish the uploaded content.
6. Paid Services
The following services are subject to a fee. Prices are clearly displayed before purchase. The Operator is a small business ("Kleinunternehmer") under § 6 (1) no. 27 of the Austrian VAT Act (UStG) and therefore does not charge VAT. Payment is processed via the payment provider Stripe.
Premium tours (consumers): Digital content with GPS navigation, provided immediately after payment is confirmed. The 14-day right of withdrawal under Austrian consumer law (FAGG) expires once provision of the digital content has begun and you have expressly consented during checkout and acknowledged that you thereby lose the right of withdrawal.
Business partner campaigns (businesses): Advertising services for businesses (banners, newsletter sponsorship, etc.), billed via Stripe. These contracts are concluded exclusively with businesses within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG); consumer withdrawal rights under FAGG do not apply.
7. Referral Partner Program (Tour Referrals)
Local businesses (e.g. hotels, accommodations, bike rental, tourism offices, gastronomy) may be admitted as referral partners by individual agreement with the Operator. Referral partners receive a personal tracking link or QR code through which they can refer paid sightseeing tours. If a purchase is made within 90 days of clicking this link, the sale is attributed to the referral partner and remunerated at the individually agreed commission rate. Commission payouts are handled by agreement outside the platform (e.g. by bank transfer); there is no automated payout claim via the platform itself. Participation in the referral partner program is by invitation or individual agreement with the Operator only; automatic registration is not provided.
8. Availability & Liability
The Operator aims for the highest possible availability but does not guarantee uninterrupted operation. Maintenance work, technical faults or force majeure may lead to temporary restrictions.
To the extent legally permissible, the Operator's liability for damages arising from use of the platform is excluded, unless caused by gross negligence or intent. The Operator assumes no liability for third-party content (e.g. external links, user-submitted tours).
9. Disclaimer — Tours & Navigation
Use of BikeGraz tours, routes, maps, GPS navigation, audio guides and other content is entirely at your own responsibility.
Local traffic rules, traffic signs, road closures, construction sites and instructions from authorities always take precedence over information and navigation guidance provided by BikeGraz. The routes provided are for orientation purposes only. Changes to traffic routing, road conditions or other circumstances may occur at any time. Please always adapt your riding to current conditions.
To the extent legally permissible, BikeGraz assumes no liability for accidents, personal injury or property damage, financial losses, detours, navigation errors, route changes, closures, delays or other damage arising from the use of the content provided.
BikeGraz assumes no liability for damage to, loss of, or theft of the mobile phone used for navigation. We recommend using a suitable bike phone mount to enable safe and comfortable navigation during the tour.
In particular, BikeGraz assumes no liability for users reaching their destination without deviations or not getting lost. Sometimes this is how you discover the most beautiful corners of Graz.
By using our services, you agree to these terms.
10. Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy, which forms part of these Terms.
11. Changes to These Terms
The Operator reserves the right to amend these Terms at any time. Registered users will be informed of material changes by email. Continued use of the platform after the amended Terms take effect constitutes acceptance.
12. Applicable Law & Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with businesses is Graz, Austria. Statutory places of jurisdiction apply for consumers. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
